On September 25, 2025, James Comey was indicted, or formally charged by a federal grand jury. He was formally accused of one count of making a false statement to Congress and one count of obstruction of a congressional proceeding.
James Comey is an American Lawyer most known for serving as the 7th Director of the Federal Bureau of Investigation (FBI) from 2013 until his firing in 2017. His career was notably marked by high–profile prosecutions, appointments under both Democratic and Republican administrations and controversy especially related to the 2016 presidential election.
In 2016, Comey announced the FBI concluded to advise not to press charges against Hillary Clinton for her use of a private email server, but continues to coin her actions “extremely careless”. Comey notified Congress of the reopening of the investigation only days before the election, due to newly uncovered emails. Both announcements drew intense criticism, with some suggesting his actions impacted the election’s outcome.
In May of 2017, President Trump fired Comey whilst the FBI was investigating Russian interference in the 2016 election and any ties to the Trump Campaign. Trump originally claimed firing Comey was related to the handling of the Clinton email investigation, but later stated he was thinking of the “Russia thing.”
Social Studies & Government teacher Brian Cushing of Bishop O’Dowd High School explained, “He has complete power to fire him since his Presidential appointment.” This established the President’s constitutional authority and power to remove executive officials like the FBI Director, but the line between legitimate use of power and abuse of political power blurred.
Following his firing, Comey arranged to leak voice memos documenting his interactions with Trump to the press and public. The voice memos included Trump allegedly pressuring Comey to end the investigation into his former National Security Advisor, Michael Flynn. An Inspector General report later revealed that Comey violated FBI policy by retaining and leaking the voice memos. However it was found there was no criminal intent.
In September 2025, a federal grand jury indicted Comey on two criminal counts related to his 2020 testimony before the Senate Judiciary Committee. The charges included making a false statement and obstruction of a congressional proceeding. Comey pleaded not guilty on October 8th, 2025 during his arraignment. Legal experts raised concerns that the prosecution was likely politically motivated. He was released after the court appearance with no restrictions placed on his whereabouts.
“One of the motions that was followed by Comey’s defense attorneys was that this was vindictive prosecution, that Trump was using his political power,” Cushing said. “Which, from what I see, has a lot of merit, because the existing U.S. Attorney refused to bring charges against Comey, so Trump basically fired that person, which he has the right to do as President. But immediately, she had the charges brought to the grand jury; that ended with Comey being charged with these crimes. So there appears to be a lot of validity to the idea of it being a vindictive prosecution.”
Cushing further explained, “I think the Justice Department is set up with the intention that once somebody is appointed to lead the bureau, they should stay out of politics.” Reflecting the expectations that the FBI and Department of Justice remain nonpartisan institutions, even when working under political administrations.
Comey’s lawyers indicated they would seek to dismiss the case, arguing that it is an act of “vindictive and selective prosecution” planned and orchestrated by President Trump. A new trial date has been set for January 5, 2026.
Beyond the legal and political implications, Cushing emphasized the importance of evaluating media through a critical lens. “ I think you have to be really smart about the sources that you read,” he said. “I teach my students about a group called AllSides, which I think does a really good job of giving you the ability to see whether the article you are reading is liberal or conservative or considered neutral.”
Adding, “So I think, especially in the environment this generation is growing up in, you need to really verify your sources and take things that aren’t verified with a grain of salt.“
Cushing advises readers that the Comey case, similar to many modern political media news, should be consumed through a careful, informed and educated lens.
